GENERAL TERMS AND CONDITIONS OF CONTRACT

INTRODUCTION

This contractual document shall govern the General Terms and Conditions of Contract for the products offered through the website www.zapatosdebaileflamenco.com, owned by ZAPATOS PASARELA, S.L., with Tax ID B-41940321 and registered office at Calle Alfarería nº123, Local A (41010 - Seville, Spain).

By accepting this document, the user acknowledges that they have read, understood, and fully comprehend its contents, possess full legal capacity to enter into a contract, and assume all obligations set forth herein.

These terms shall remain valid indefinitely and shall apply to all contracts concluded through the website.


IDENTITY OF THE CONTRACTING PARTIES

On one side, the supplier of the products is ZAPATOS PASARELA, S.L., and on the other side, the user, who shall register on the website by creating a personal account. The user is responsible for the accuracy of the personal information provided.


REQUIREMENTS FOR PURCHASE

Only persons over 18 years of age may purchase products who:

  • Are registered as users of the website.

  • Have fully accepted these General Terms and Conditions.

  • Have correctly completed the purchase process.


SCOPE OF APPLICATION

These conditions apply to all purchases made through this online store, regardless of the delivery destination. Shipments are made throughout the national territory, including the Canary Islands, Ceuta, and Melilla, as well as to international destinations.

OBJECT OF THE CONTRACT

The purpose of the contract is the legal, technical, and economic regulation of the acquisition of products offered on the website.


MODIFICATION OF THE TERMS

ZAPATOS PASARELA, S.L. may modify these terms at any time, with the version in effect at the time of the order being applicable. Modifications shall not affect orders already placed.


CONTRACTING PROCEDURE

The user must follow the purchase process described on the website. Once the order is confirmed, an email will be sent with the confirmation. The contract shall be deemed perfected from the moment the confirmation email is received.


TECHNICAL MEANS TO CORRECT ERRORS

During the purchase process, the system allows the user to review and modify the information entered before final confirmation of the order. Once the order has been validated, any corrections must be requested via email at zapatosdebaile@robertogarrudo.com prior to shipment.


CONTRACT ARCHIVING

Formalized orders will be stored electronically. The client may request a copy by writing to zapatosdebaile@robertogarrudo.com indicating the order number. The copy will not include banking information for security reasons.

PAYMENT METHODS

Accepted payment methods are:

  • Credit card (Redsys gateway)

  • Bank transfer

  • PayPal (no additional charge)

  • Bizum

ZAPATOS PASARELA, S.L. uses a secure SSL payment system and may require payment confirmation before dispatching the order.


PRICE

Prices are expressed in euros (€), include VAT, and, where applicable, the shipping costs specified during the purchase process. For special large-quantity orders, direct contact is allowed for customized conditions.


COUPONS AND PROMOTIONS

Discount coupons or promotions will be valid under the conditions and deadlines indicated. They cannot be combined or applied to discounted products, unless expressly stated. They do not apply retroactively.


CUSTOMER SERVICE

We commit to respond within a maximum of 48 business hours.


ORDER DELIVERY

Orders will be delivered via courier to the address provided by the user.

Delivery shall be deemed effective when the user signs for receipt. The user must check the product's condition upon delivery.

ZAPATOS PASARELA is not responsible for delays due to causes beyond its control, such as holidays, user errors, or courier issues.


DELIVERY TIMES AND CONDITIONS

Order preparation will begin after confirmation. The times indicated are approximate and counted in business days. In case of stock shortages, the user will be informed to decide whether to wait, modify, or cancel the order.

ESTIMATED DELIVERY TIMES BY DESTINATION

  • Mainland Spain and Portugal: 1–3 business days

  • Balearic Islands: 2–4 business days

  • Ceuta, Melilla: 3–10 business days

  • Canary Islands: 3–10 business days

  • Europe Zone 1: 2–5 business days

  • Rest of Europe: 2–7 business days

  • United States and Canada: 3–5 business days

  • Australia and New Zealand: 3–15 business days

  • Other countries and remote destinations (Africa, America, Asia, and Oceania): 3–20 business days

INTERNATIONAL CUSTOMS INFORMATION

Customs costs for destinations outside the EU shall be borne by the customer. These may cause additional delays beyond the control of ZAPATOS PASARELA, S.L.


SHIPPING AND DELIVERY CONDITIONS

The shipping company will provide a tracking number. If no one is present at the time of delivery, a notice will be left. The customer is responsible for any errors in the address or unjustified refusals.


DELAYS DURING HIGH-DEMAND PERIODS

During campaigns such as Black Friday, Christmas, or Sales, delivery times may be affected. ZAPATOS PASARELA, S.L. will keep the customer informed.


ORDER CANCELLATION AND MODIFICATION

The order may be canceled:

  • By the user: within 48 hours after confirmation and before dispatch.

  • By ZAPATOS PASARELA, S.L.: due to lack of stock or non-payment.

Orders may be modified before dispatch by contacting zapatosdebaile@robertogarrudo.com.


RIGHT OF WITHDRAWAL

The user may return products within 15 calendar days from receipt. The product must be new, unused, and in its original packaging with all labels intact.

To exercise the right of withdrawal, the user must send the corresponding form to:

ZAPATOS PASARELA, S.L. will refund the amount of the returned item within a maximum of 14 days from notification. The user will bear the return shipping costs.


SIZE OR MODEL EXCHANGES

Size or model exchanges are allowed within the same 15-day period. The product must be unused and in its original packaging. Costs related to the exchange will be borne by the customer. Prior contact with customer service is required.


WARRANTY AND DEFECTIVE PRODUCTS

ZAPATOS PASARELA, S.L. guarantees that all products sold on this website comply with the legal conformity warranty established in Royal Legislative Decree 1/2007 of November 16.

In case of non-conformity of the goods, the user has the right to have them repaired, replaced, obtain a price reduction, or terminate the contract, according to legally established conditions.

The warranty period is three years from delivery of the product.

During the two years following delivery, it shall be presumed that the non-conformity already existed at the time of delivery, unless proven otherwise.

LIMITATION OF LIABILITY

ZAPATOS PASARELA, S.L. shall not be liable for failures arising from force majeure or fortuitous events.

INTERNAL CLAIMS PRIOR TO ODR

Before initiating an online dispute resolution procedure, we invite the customer to contact our team via zapatosdebaile@robertogarrudo.com to attempt to resolve any issues amicably.

PERSONAL DATA PROTECTION

In compliance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD), we inform you that the personal data provided by the user during the contracting and purchase process will be processed by ZAPATOS PASARELA, S.L., as the data controller, for the purposes of managing the contractual relationship, shipping the purchased products, handling requests, and fulfilling legal obligations arising from the contract.

The legal basis for processing is the execution of the sales contract, compliance with legal obligations, and, where applicable, the user’s consent for additional purposes such as receiving commercial communications.

Data will not be disclosed to third parties except under legal obligation or when necessary for proper service provision (e.g., transport companies).

Users may exercise their rights of access, rectification, erasure, objection, restriction of processing, and data portability by email to zapatosdebaile@robertogarrudo.com, or by postal mail to Calle Córdoba nº9 (41004-Seville, Spain). If there are reasonable doubts regarding the identity of the requester, additional information strictly necessary to verify it may be requested.

CONTRACT LANGUAGE

The contract is executed in Spanish. In case of conflict between versions, the Spanish version shall prevail.


APPLICABLE LAW AND JURISDICTION

These terms shall be governed by Spanish law. In the event of a dispute, the parties submit to the courts of the user’s domicile.
